Sewing Classes in Wheeling, West Virginia

Terms of Participation:

As a condition of registering for an Edgington Studio sewing lesson or class, you agree to the following terms and conditions:

·       Registrations must be paid ahead of the lesson/class and are non-transferrable. Refunds will be issued to the original payment method only for cancellations made at least 24 hours before the start of the lesson/class. A "No-Show" will be marked 10 minutes after the lesson or class start time and will require the lesson or class to be rescheduled to respect subsequent lessons that day.  In the unlikely event that an lesson/class must be cancelled or postponed by Edgington Studio due to unavoidable circumstances or inclement weather, or if a class is undersubscribed, we will try to give you at least 24 hours’ notice if possible, in which case you may reschedule your lesson/class, or request a refund, but we will not be liable for any other costs, wasted travel, damages or expenses that you may have incurred.

·       By scheduling a lesson or registering for our classes, you acknowledge and accept that Edgington Studio will take all reasonable precautions to help ensure the safety of the class participants.   Edgington Studio requires students to conduct themselves in a reasonable, safe and proper manner. Students may be asked to leave the premises in the event they interfere with Edgington staff or other students’ participation in the class, or otherwise engage in any violent, dangerous, destructive, indecent, disorderly, threatening, intimidating or offensive behavior or language.  You understand that if you or your child is asked to leave the premises, your registration fee will not be refunded.

·       During your lesson/class you will see some of our work in progress, which includes projects we are completing for clients.  As a result, no photography or videography is permitted in the Studio.  Many of these projects are proprietary to the client, and we are required to maintain the as confidential.  Therefore, as a condition to inviting you today, we must ask that you also maintain the projects and elements thereof (the “Confidential Information”) that you see in our studio as confidential, and not use them for any purpose, or disclose them to any other person or entity.  Note that Confidential Information as discussed above does not include any information that: (a) is or becomes generally available to the public other than as a result of your disclosure; (b) is obtained by you on a non-confidential basis from a third-party that was not bound by a similar obligation of confidentiality; (c) that you knew prior to your visit; or (d) that you independently develop without using any Confidential Information.  In the event you breach the obligations under this Statement, we and our clients may have limited remedies, and we or they may need to file for equitable relief in a court of law.  You acknowledge that should this be necessary, we may request such relief without posting bond.  You further waive any claim or defense that we or our clients have an adequate remedy at law.

·       You acknowledge that participating in sewing involves certain risks from use of machinery and tools associated with apparel manufacturing.  You hereby give consent to Edgington Studio and its staff to undertake or allow others to undertake any necessary medical treatment to be administered to you (or your child) in the event of an emergency, and further agree to be responsible for any associated medical expenses.

·       Furthermore, to the fullest extent permitted under law, you, your heirs, and executors hereby release, agree to indemnify and hold harmless, Edgington Studio, its owners and staff, for any personal injury, damages, or financial loss which you may incur during the lesson/class, and further agree to indemnify and hold Edgington Studio, its owners and staff, harmless from any third party action or threatened action resulting from your participation in an lesson/class, or otherwise relating to your actions while on Edgington Studio’s premises, including reasonable attorneys’ fees.  You agree that the Edgington Studio, its owners and staff, shall not be liable to you for any type of damages, including direct, indirect, special, incidental, equitable, or consequential loss or damages for your participation in a sewing lesson or class, whether based on contract, tort, negligence, strict liability, or otherwise, even if Edgington Studio or its owners or staff has been advised of the possibility of damages.

·       You certify that you are 18 years or older, or a parent/guardian giving permission for your minor to take the class.  Please note that this class will involve using a home sewing machine and/or hand sewing needles, seam rippers, pins, and scissors and therefore participants under 12 years old must have an accompanying adult.
